1. Acceptance of Terms
By accessing or using the Cartway platform, mobile applications, websites, or any services provided by Cartway Technologies ("Cartway," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
Cartway provides a technology platform that connects users who need delivery services with independent delivery partners ("Riders"). Our services include:
- On-demand delivery services for individuals and businesses
- Pickup and delivery coordination
- Real-time tracking and communication
- Payment processing and transaction facilitation
- Guest checkout for one-time deliveries
3. User Accounts & Guest Access
Registered Users: To access certain features, you may create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Guest Users: We offer guest checkout allowing you to request deliveries without creating an account. Guest users must provide valid contact information and payment details for each transaction.
4. User Conduct
You agree to:
- Provide accurate and complete information
- Use the services only for lawful purposes
- Not interfere with or disrupt the platform
- Treat Riders and other users with respect
- Not ship prohibited or illegal items
- Comply with all applicable local, state, and federal laws
5. Payments and Fees
Delivery fees are calculated based on distance, package size, and demand. You agree to pay all charges associated with your delivery requests. We accept various payment methods including cards, mobile money, and bank transfers.
Prices are subject to change. Cancellation fees may apply if you cancel a delivery after a Rider has been assigned.
6. Refund Policy
In the event of a failed delivery due to circumstances within our control, Cartway will process a refund. Please note:
- Wallet Refunds: All refunds will be credited to your Cartway Wallet, not to your original payment method
- Refunds are typically processed within 24-48 hours of a confirmed failed delivery
- Wallet balances can be used for future deliveries on the platform
- Refunds may not apply if delivery failure was due to incorrect information provided by the user, recipient unavailability after multiple attempts, or prohibited items
To request a refund, contact our support team with your delivery reference number.
7. Insurance & Goods in Transit (GIT) Coverage
Cartway provides Goods in Transit (GIT) insurance coverage for packages delivered through our platform:
- Standard Coverage: All deliveries include GIT insurance coverage of up to ₦15,000 at no additional cost
- This coverage applies to loss or damage of items during transit due to accidents or mishandling
- Additional Insurance: For high-value items exceeding ₦15,000, users may opt for additional insurance coverage when available on the platform
- Claims must be filed within 48 hours of delivery completion or failed delivery
- Proof of item value (receipts, invoices) may be required for claims
Exclusions: Insurance does not cover perishable items, prohibited goods, items improperly packaged, or damage due to recipient handling after delivery.
8. Rider Relationship
Riders are independent contractors, not employees of Cartway. We do not control the manner or method of delivery. While we verify Riders and provide ratings systems, we are not responsible for their individual actions.
9. Liability and Disclaimers
Cartway provides the platform "as is" without warranties of any kind. We are not liable for:
- Delays due to traffic, weather, or other unforeseen circumstances
- Damage to items not properly packaged
- Loss of items due to incorrect delivery information
- Actions of third-party Riders beyond our reasonable control
- Losses exceeding the GIT insurance coverage limit for uninsured items
10. Intellectual Property
All content, trademarks, and intellectual property on the Cartway platform are owned by or licensed to Cartway. You may not copy, modify, or distribute our content without written permission.
11. Termination
We reserve the right to suspend or terminate your access to our services at any time for violations of these terms or for any other reason at our discretion.
12. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the platform after changes constitutes acceptance of the new terms.
